Substitute Section 84 CrPC
In course of attachment of property of an absconding accused,if property of third person is also attached due to the reason of being coparcener in property with that accused or being joint partner in property with that accused,then who is responsible.Police,court or law?
A such nature of case brought to my consideration by one such victimized accused,upon which my opinion produced before him is reproduced below-
अच्छा होता कि यदि किसी आरोपी का सिर्फ उसके नाम से उसका सम्पति दर्ज नहीं होता है तो उसके संयुक्त सम्पति और पैतृक सम्पति में उसकी हिस्सेदारी को कुर्क करने के लिए कोर्ट का अनुमति लिया जाता लेकिन ऐसा प्रावधान है ही नहीं।CrPC का धारा 83(1) में स्पष्ट रूप से लिखा है कि सिर्फ फरार घोषित व्यक्ति के सम्पति की कुर्की का आदेश कोर्ट दे सकती है लेकिन ये नहीं लिखा है कि यदि उसके संयुक्त सम्पति और पैतृक सम्पति में उसकी हिस्सेदारी को कुर्क करना है तो इस बाबत कोर्ट का अनुमति के अनुसार कार्यवाही करने की क्या प्रक्रिया है।धारा 83(3) और धारा 83(4) में क्रमशः लिखा है कि चल और अचल सम्पति को कुर्क कैसे की जाएगी और किसे अधिकृत कर की जाएगी।धारा 84 में प्रावधान है कि यदि कुर्क की गयी सम्पति में फरार घोषित व्यक्ति के सिवाय किसी तीसरे व्यक्ति का भी हित है है तो वो कुर्की की तारीख से 6 महीने के भीतर कोर्ट में दावा और आपत्ति दायर कर सकता है।
कहने का मतलब है कि संयुक्त सम्पति और पैतृक सम्पति में फरार व्यक्ति के सिवाय किसी और व्यक्ति का हिस्सेदारी है तो वो पहले अपने हिस्से की सम्पति का साथ में कुर्की करवाये और फिर बाद में दावा और आपत्ति दायर कर कोर्ट से सम्पति वापस प्राप्त कर ले लेकिन कुर्की होने से पहले ही दावा और आपत्ति कोर्ट में नहीं करे।
अच्छा होता कि CrPC की धारा 84 को प्रतिस्थापित कर ये प्रावधान कर दिया जाता कि धारा 83 के तहत फरार व्यक्ति की सम्पति की कुर्की का आदेश पारित होने के बाद जिस किसी भी तीसरे व्यक्ति का उस फरार व्यक्ति के साथ संयुक्त और पैतृक सम्पति में हिस्सेदारी है वो कुर्की होने से पहले एक नियत समय के भीतर अपने हिस्सेदारी वाली सम्पति का कुर्की होने से बचाने के लिए कोर्ट में दावा और आपत्ति दायर करे।
इसलिए यदि फरार व्यक्ति के हिस्सेदारी के साथ किसी तीसरे व्यक्ति की संयुक्त और पैतृक सम्पति में हिस्सेदारी को कुर्क कर ली जाती है तो मैं पुलिस और कोर्ट को कहीं भी दोषी नहीं पाता हूँ।कानून ही उल्टा है इसलिए कानून ही दोषी है।

Bihar Electricity Theft Scam
After a long gap i am updating my status and i shall now try to maintain continuity on facebook.
Firstly i apologize for the reason that i couldn’t write about Bihar Electricity Theft Scam which was assigned to me even more than two months earlier by one senior whistle blower.Due to engagement in many legal and social works as well as also in some personal cases,i couldn’t find sufficient time to write anything on facebook including this scam.However,i have face to face discussed with some people about this scam.The Govt Of Bihar and Patna High Court has saved many rich thieves of electricity who embezzled crores of rupees by using tampered meter in collusion with the Bihar State Electricity Board,thereby paying much less electricity bill than actual.I shall now focus on each fact and legal aspect of this scam in some subsequent updates.
Whenever i shall be competent i shall file a Public Interest Litigation in the Supreme Court against this scam.
